London Fischer attorney James Walsh obtained summary judgment on behalf of Welsbach Electric Corp. (“Welsbach”) and The City of New York (the “City”).
The Court found that Welsbach fulfilled all of its contractual obligations as a matter of law after receiving notice of a downed traffic signal. Welsbach had arrived at the intersection and taken measures to safeguard the intersection to prevent further damage. The Court expressly found that Welsbach’s response made the location safer, not dangerous.
