One month before trial, London Fischer was asked to substitute in as trial counsel in a case with a $9 million demand, venued in a liberal venue with serious bodily injuries and scarce discovery on liability. As the case had been proceeding for four years prior to London Fischer’s 11th hour involvement, the Court precluded our efforts to present evidence from accident reconstruction and bio-mechanical experts. Plaintiff alleged serious spinal injuries which included both cervical and lumbar surgeries, as well as knee surgery. The key defense witness had never been deposed and no liability experts had been appointed. The $9 million demand prior to the start of the trial was reduced to six figures during the trial. The Westchester County, New York Supreme Court jury returned a defense verdict in favor of our client.
