On December 20, 2022, California partners, Julie Van Wert and Jerome Doctors, and New York partners, James Deaver and Wendy Keenan conducted a webinar for more than 80 claim executives at a prominent insurance company. They discussed “Five Things to Know about Allocation” in the connection with an insurer’s obligation to pay defense costs and settlements only for covered claims. They discussed the benefits of allocation, when and the basis upon which an insurer is entitled to an allocation, as well as the common law approaches in New York, New Jersey, and California in the absence of an allocation provision in an insurance policy. They ended the webinar by providing practical tips to the executives and answering several questions.
