On October 15, 2024, the London Fischer panel shared insights about allocation-related law in multiple jurisdictions and offered practical tips for developing the underlying factual record often necessary for obtaining allocation of defense and/or indemnity expenses, when possible, between covered and non-covered claims, as well as between covered and non-covered parties. Proper allocation of settlements, judgments and/or defense costs can generate substantial savings for insurers. So, a good understanding of the contractual and legal landscape in this area is important.
